The various authorities operate under the premise that driving is a privilege. The privilege view is the traditional view. The privilege view was acceptable years ago when driving was not nearly so important to the pursuit of life, liberty and happiness. In today's highly mobile and automobile-centric world, driving should be the right of all capable adult citizens. Urban sprawl, the absence of sidewalks, regional malls and shopping centers, consolidated educational institutions, consolidated churches, industrial parks, rural subdivisions and many other institutions of modern society reflect the importance of the automobile to individual opportunity. It is clear that any citizen deprived of the right to drive is at a severe disadvantage when it comes to economic, social and cultural opportunities. Driving rights should only be suspended or revoked with due process and then only for severe and continued offenses where the public is in clear and iminant danger if the individual's right to drive is not terminated. The right of the individual to pursue life, liberty and happiness via the right to drive must be protected.
