The DOT, the state and the county are all very happy and willing to take your driver's license from you for your first offense of OWI (and for many other reasons). In fact the DOT will indeed suspend your license if your BAC is above the legal limit. If your chemical test comes back over .08, your license will be suspended without due process.
You are allowed an administrative hearing if you request it within 10 days of the notice to suspend. Unfortunately for you, the administrative review is a simple rubberstamp procedure. It will do nothing to stop the suspension. The first-hand experience of this writer is that the DOT reviewer shows great interest in keeping his limit of 15 minutes per review but shows little interest in the actual facts surrounding the arrest. If my review is representative of the reviewer's overall work, he is incompetent and should be fired. His work is a sad commentary on the state's use of our tax dollars.
