What can a regular person do?

Fight back!! Don't just pay your OWI fine. Demand a jury trial. It's your right. It's inexpensive for you but very costly for the authorities. It can help to promote a change in the drunk driving laws as the profit to the local government disappears.

If arrested and charged with OWI, you have the right to contest the charge in court. You can do it without an attorney if you can't afford one. If all OWIs would go to court, the laws would have to be changed because the courts would be so badly clogged. It only costs $35 in my county to demand a jury trial. It's worth it. I've been told by lawyers and prosecutors that most judges will convict. With a jury, you have a better chance. It will cost the county more to convict you then you will pay in fines. It's a way to fight back. You will most likely lose your case if you do not have an attorney. But by making them convict you in court, you take away their profit incentive and help to clog up the court system. (A court system that supports such injustice against good citizens should be clogged.) If you just pay the fine, you make it very worth their while to have arrested you.

What else? Contact your legislators and tell them to roll back the drunk driving laws to a time of reason. Let's get rid of the BAC laws that convict you based on your blood levels. Since different people handle different levels of alcohol differently, these laws are inherently unfair. The lower the legal BAC level the more unjust the law. We should expect that our law enforcement professionals can clearly prove and win their drunk driving cases if the drivers are truly impaired. If not, then so be it. Justice is served as it should be. Remember, millions of these arrested folks have harmed no one.
